GaiaBerry App Terms of Use

About these terms

These terms apply to your use of the GaiaBerry app, provided by GaiaBerry (Pty) Ltd, a South African company ("GaiaBerry", "we"). By using the app you agree to them. Purchases of products on gaiaberry.co.za are covered by the website's own terms.

Not medical advice

The GaiaBerry app provides general wellness information about natural fertility, nutrition, herbs and lifestyle. It is not medical advice. It does not diagnose, treat, cure or prevent any condition, it cannot guarantee a pregnancy, and it is not a substitute for your doctor, midwife or fertility specialist. Statements about our products have not been evaluated by the South African Health Products Regulatory Authority (SAHPRA).

Always see a doctor if you have not conceived after 12 months of trying (6 months if you are 35 or older), have very irregular or absent periods, severe pain or heavy bleeding, or are on medication or fertility treatment such as IVF. Check with your doctor or pharmacist before starting any herb or supplement, especially if you take medication.

In an emergency, call emergency services immediately (in South Africa 10177, or 112 from a mobile). Do not delay seeking care because of anything in the app.

Cycle predictions are estimates

Predicted periods, fertile windows and ovulation days are estimates based on what you log. They can be wrong, especially with irregular cycles. Never use the app as contraception or to avoid pregnancy.

Gaia, the AI assistant

Gaia's answers are generated by artificial intelligence from GaiaBerry's own content. They can be incomplete or wrong. Gaia does not know your full medical history and is not a healthcare professional. Do not rely on Gaia for diagnosis, dosing beyond product labels, or urgent decisions. Free users can ask 3 questions in total; Premium includes unlimited questions within a fair-use limit that protects the service for everyone.

Your account

You must be 18 or older to use the app. Keep your login details private; you are responsible for activity on your account. You may delete your account at any time in Profile.

Premium subscription

• Premium is an auto-renewing subscription, sold monthly or yearly through the Apple App Store or Google Play. Prices are shown in the app in your local currency before you buy (in South Africa R79 a month or R499 a year at launch).
• First-time subscribers get a 7-day free trial. Unless you cancel at least 24 hours before the trial ends, it converts to a paid subscription and your store account is charged. We remind you 2 days before the trial ends.
• The subscription renews automatically at the end of each period unless you cancel at least 24 hours before the renewal date.
• Cancel any time in your App Store or Google Play subscription settings. You keep Premium until the end of the period you paid for. Deleting the app or your account does not cancel the subscription.
• Payments, refunds and billing are handled by Apple or Google under their terms; refund requests go to them. Nothing in these terms limits your rights under the Consumer Protection Act or the Electronic Communications and Transactions Act that cannot lawfully be limited.
• We may change prices with notice in the app; a new price applies only from your next renewal after the notice.

Premium discount on GaiaBerry products

While your Premium subscription is active, you get a discount code for GaiaBerry orders on gaiaberry.co.za (10% at launch). The code is for your personal use, cannot be exchanged for cash and cannot be combined with other offers unless stated. We may change or end this benefit with notice in the app.

Products and the ethanol notice

Product suggestions in the app are general. Product pages, prices, delivery and returns are governed by gaiaberry.co.za. Our tinctures, drops and kits are extracted in food-grade ethanol, made according to SANHA Halaal standards. Ethanol is listed in the ingredients, so it is not a reason for a refund, return or exchange. In pregnancy mode the app only suggests products that GaiaBerry considers suitable for the stage of pregnancy; always confirm with your doctor or midwife.

Acceptable use

Do not misuse the app: no attempts to get around the free limits or the paywall, reverse-engineer or overload the service, scrape content, or use Gaia to produce harmful content.

Content and intellectual property

The app's programmes, guides, recipes, text, images and branding belong to GaiaBerry or its licensors. You may use them for your own personal, non-commercial use only.

Liability

We provide the app with care, but cannot promise it will always be available or error-free. To the extent the law allows, GaiaBerry is not liable for indirect or consequential loss arising from your use of the app or from relying on its general information. Nothing in these terms limits liability that cannot be limited by law.

Changes and ending

We may update these terms, and will tell you in the app before a material change takes effect. You can stop using the app and delete your account at any time. We may suspend accounts that break these terms.

Law and contact

These terms are governed by the laws of the Republic of South Africa. Questions or complaints: info@gaiaberry.co.za. We will first try to resolve any dispute in good faith; failing that, it may be referred to the National Consumer Commission or a competent South African court.
