These terms govern your use of gaiaberry.co.za(“the site”) and any purchase you make from us. By using the site or placing an order you confirm that you accept these terms.

About us

GaiaBerry is a South African business operating from the Republic of South Africa. You can contact us at info@gaiaberry.co.za.

Orders & pricing

All orders are subject to availability and acceptance. Prices are listed in South African Rand (ZAR) and are inclusive of VAT where applicable. We reserve the right to refuse or cancel any order, in which case any payment received will be refunded in full.

Payment

Payment is processed securely via Shopify. We do not see or store your full card details.

Returns, refunds & cooling-off (CPA)

Under section 16 of the Consumer Protection Act, 2008 (CPA), you may cancel an order made as a result of direct marketing within 5 business days of receipt and return the goods at your own cost for a full refund of the purchase price, provided the goods are unopened, unused and in their original packaging.

Under CPA section 56 you may also return goods within 6 months of delivery if they are defective, unsafe, or do not match the description on our site, for a refund, replacement or repair at your election. Faulty goods are returned at our cost.

For health and safety reasons we cannot accept returns of opened consumable products (powders, tinctures, capsules) other than where CPA section 56 applies. To start a return, email info@gaiaberry.co.za with your order number and we will guide you through the process. Refunds are processed within 10 business days of us receiving the returned goods.

Shipping

Shipping rates, zones and timeframes are described on our Shipping & Delivery page. Risk in the goods passes to you on delivery.

Health disclaimer

The information on this site is provided for educational purposes only and is not medical advice. Statements made about our products have not been evaluated by SAHPRA, and our products are not intended to diagnose, treat, cure or prevent any disease. Always consult a registered healthcare practitioner before starting any herbal protocol, particularly if you are pregnant, breastfeeding, on medication, or being treated for a medical condition.

Intellectual property

All content on the site — text, photography, branding and graphics — is owned by or licensed to GaiaBerry and may not be copied, reproduced or used commercially without our written permission.

Acceptable use

You may not use the site to transmit malicious code, scrape commercial data, harass our agents or customers, or attempt to access areas of the site for which you do not have authorisation.

Limitation of liability

To the maximum extent permitted by law, GaiaBerry is not liable for any indirect, incidental or consequential loss arising from use of our products outside their intended traditional use, or from your use of this site. Nothing in these terms limits any right you have under the CPA which cannot lawfully be limited.

Governing law & disputes

These terms are governed by the laws of the Republic of South Africa. Any dispute will be referred first to good-faith discussion between us; failing resolution, to the National Consumer Tribunal or the appropriate South African court.

Changes

We may update these terms from time to time. The version in force is the one published on this page at the time of your order.
